By ordering services from Bill Breneman Photography (also known as "BBP") you (also known as "Client") agree to the following Service Agreement for digital imagery:
Client agrees to:
(A) Payment of photo shoot in full before the shoot takes place (Applicable to Commercial and Real Estate brokers/agents)
(B) Having unrestricted permission to use photos for listing and marketing purposes (understanding photos on MLS are often syndicated to other real estate websites and listing aggregators);
(C) A nonexclusive agreement with BBP - meaning that BBP's images can be used for promotional purposes for an unlimited period of time (except when marketing a residential or commercial real estate listing - in which case, the images can be used as long as the listing is active and promoted by the specific agent BBP produced the images for);
(D) Understanding that due to various editorial/publication preferences, a client is permitted to edit/alter images, following initial delivery of edited images by BBP - and shall hold BBP and any successors, legal representatives and assigns harmless from all claims of liability resulting from or associated with the use of the material;
(E) Not provide images to a third party or to an agent who takes over an expired or withdrawn listing.
Bill Breneman Photography is the copyright holder, and retains all copyrights expressed and implied otherwise for all made images. Copyright is not and will not be transferred to any other/third party, such as designers, stagers, builders, etc. Client also warrants that they have authority to enter into this agreement for the property, and shall indemnify and defend BBP in the event of any litigation arising due to this agreement. Copyright shall accrue to the benefit of his/her successors, legal representatives and assigns.
Property Owner Policy
Property owners/buyers may desire copies of images and secure them from BBP only. BBP will make images of the property available for the property owner through a specific gallery set up through BBP's website.
Digital downloads are available at full resolution (or sized down) - either through this website via this website's download procedure, or through Dropbox. Download tutorials can be provided upon request.
The property owner shall ensure that there are no hazards to the photographer’s safety. If shooting an MLS listing, the photographer will work with agents and/property owners regarding pets/animals to keep them removed from the photography project, but the photographer is not a pet wrangler. If pets will be an issue, please make a note of it when ordering services.
BBP will be photographing through the entire home/structure. BBP does not usually include closets, but if you would like those included please let us know prior to the shoot. BBP works on a set time schedule for every shoot. Time is a precious commodity. It is the agent’s responsibility to work with the property owner to ensure that the listing is ready for the photo shoot at the arranged time. Also, please do not schedule in-home tours, visitations or have contractors working at the home during the photography appointment.
Here are some staging tips to help prepare a listing for a photo shoot. Please feel free to share these with your client, if applicable:
- Turn on all lights, including overhead stove/microwave lights, novelty lights, toe-kick and under-cabinet lighting.
- All horizontal surfaces (tables, countertops, seats, mantles) are clean and free of personal items.
- Blinds are down with slats being horizontal, so the maximum amount of light can enter a space.
- All rugs removed from bathrooms, kitchens, etc. Spaces look larger with those items removed.
- Pools and hot tubs should be uncovered and clear of debris, and maintenance equipment.
- Arrange towels neatly, lower toilet seats, have full rolls of toilet paper on holders.
- Make sure beds are made, rooms are clear of clutter, and garbage cans emptied.
- Windows/window treatments are devoid of dust, bird droppings and dead bugs.
- Property's exterior is neat, trimmed and pruned with garbage removed.
- Hide hoses, trashcans, tools, recreational/leisure items in the garage.
- Remove personal effects from refrigerators and other appliances.
- Remove vehicles from driveways and the front of the property.
- Sweep driveway, sidewalks, decks and patios clean of debris.
- Check all light fixtures and replace burnt-out bulbs.
- Turn off sprinklers.
Bill Breneman Photography understands that properties and structures may not be ready for shooting as expected. It is the responsibility of the agent or marketing representative/manager to inform BBP as soon as possible for rescheduling. A photo session that is rescheduled or canceled after 8pm the day before the scheduled shoot will be charged a $50 rescheduling fee, plus any additional expenses, should the project involve travel/lodging/food (etc.) outside of Central Oregon (Deschutes, Jefferson and Crook Counties) when traveling to, and staying near the shoot location. Reschedules will be subject to BBP's availability.
There will be times services cannot be completed due to weather. In those circumstances, the decision about shooting is up to the client. If the client chooses to proceed with photography, BBP will provide the best images possible. If additional outdoor photos are required on a better weather day, our standard fees will apply. No reschedule fee will be charged in the event of bad weather. Reschedules will be subject to availability.
Full payment will be received prior to the beginning of the shoot (Commercial and Residential Realtors only). Credit card payments can be processed on site by "Square" or a check can be made out to "Bill Breneman Photography" prior to the session.
